The probate process involves filing the will with the court, gathering the assets, determining the validity of creditors’ claims, preparing and filing estate tax returns to obtain tax clearance and distributing assets in accordance with the terms of the will. The probate court oversees the administration of the estate from the determination of the validity of the will through the final distribution of the assets. If the individual died without a will, he or she is said to have died intestate and the estate is administered in accordance with state statutes. In both cases, an individual or corporate institution can act as an executor, if named in the will, or an administrator, if named by the court. That executor or administrator is responsible for settling the estate of the decedent.
